The first sentence says "Macintrye agrees that he has a duty to obtain new employment to mitigate any damages arising from termination under this paragraph 16"
 
Wait so the buyout is really only $6,900,000 since he gets $2,300,000 per year and it was signed through 2021 (19, 20 and 21)?

Also if this went into a full on legal battle courts don't care about what kind of job get to mitigate losses in normal contract law right?

I read it similarly. I just didn’t see a penalty other than Colorado suing him to dispute the scope of his buyout. I am sure there will be some offset. I’m just unsure how much.

It will just be negotiated, the duty to mitigate black letter law. I guess MM could try to save some money by arguing that his firing reduced his ability to earn, but I would expect most of his future salary to offset what CU pays.

I know interns get all of the blame when something goes wrong, but wouldn't you think that a 20 something kid is way more tech savy and more skilled in the digital world than your average 40-50 year old white guy?
